By using our Rip & Ship service, you automatically agree to these terms and conditions. Placing an order means you have read and accepted these terms.

1. WHAT IS RIP & SHIP?
 
Our Rip & Ship service works as follows:
 
• You order Pokémon TCG booster packs via our 
  Rip & Ship page
• We open these packs LIVE ON TWITCH @SurgicalTCG
• Your name is called when your pack(s) are up
• All cards from your pack(s) are shipped to you
• You pay for the EXPERIENCE and the CHANCE of 
  obtaining valuable cards, not for specific cards

2. THE NATURE OF BOOSTER PACK OPENINGS
 
2.1 Random Content
 
BOOSTER PACKS CONTAIN RANDOM CARDS. This means:
 
• Pack contents are NOT KNOWN IN ADVANCE and 
  cannot be guaranteed
• Each pack may contain cards of different values
• SurgicalTCG has NO CONTROL over which cards 
  are in packs - this is determined by the 
  manufacturer
• Packs are opened live - you see exactly what 
  comes out
• All products we use are 100% authentic and 
  not tampered with
 
🚫 NO VALUE GUARANTEES
 
There is NO guarantee that the value of cards you receive equals or exceeds the amount you paid. This is inherent to booster pack openings and is fully accepted upon purchase. You are buying the EXPERIENCE of live opening, not specific cards.
 
2.2 What We Guarantee
 
We guarantee that:
 
• All packs we open are 100% original and 
  authentic
• Packs are not weighed, scanned, or tampered with
• All packs remain unopened until the livestream 
  moment
• Openings are fair and transparent on livestream
• All cards from your pack(s) are shipped to you

3. RETURN POLICY & REFUNDS
 
⛔ ALL SALES ARE FINAL - NO RETURNS
 
Due to the nature of Rip & Ship, we do NOT accept returns, refunds, or exchanges for the following reasons:
 
• DISAPPOINTMENT WITH PULLS: Because booster 
  pack contents are random, we do not accept 
  claims that cards are "not valuable enough" 
  or "disappointing." You buy the chance, not 
  the result.
 
• EXPECTATIONS: It is your responsibility to 
  research the potential contents of sets before 
  ordering. We are not responsible for unrealistic 
  expectations about pull rates or card value.
 
• LIVE VERIFICATION: All openings happen live 
  on stream where you can follow the process. 
  You see exactly which cards come from your 
  pack(s). This serves as proof of a fair opening.
 
• PRODUCT IS "CONSUMED": Once a pack is opened 
  on stream, the product is consumed and cannot 
  be reversed.
 
• BUYER'S REMORSE: After placing an order, it 
  cannot be cancelled. You purchase the right 
  to see your pack(s) opened live and receive 
  the cards.
 
• MARKET VALUE FLUCTUATIONS: We are not 
  responsible for changes in card value after 
  opening or after shipping.
 
EU CONSUMER RIGHTS NOTICE:
Under EU consumer protection law (Directive 2011/83/EU), you normally have a 14-day cooling-off period for online purchases. However, this right does NOT apply to:
 
• Sealed products that have been unsealed after delivery
• Services that are fully performed with your prior consent before the end of the withdrawal period
 
By ordering Rip & Ship, you EXPLICITLY WAIVE your right of withdrawal because:
1. The service (pack opening) is performed immediately on livestream
2. The product is "consumed" once opened and cannot be reversed
3. You give explicit consent for immediate service delivery
 
This waiver is in accordance with Article 16(c) and 16(a) of EU Consumer Rights Directive 2011/83/EU.
 
3.1 Exceptions (Only in these cases)
 
Returns or refunds are ONLY considered in the following situations:
 
• PACKAGE NOT RECEIVED: If your package does 
  not arrive within expected delivery time 
  (see section 5.1 for delivery times per country) 
  AND tracking confirms non-delivery
 
• MISSING CARDS: If the number of cards you 
  receive does not match what came from your 
  pack(s) live (stream recording serves as proof)
 
• WRONG CARDS SHIPPED: If you receive cards 
  that are not from your opening
 
• PACK NOT OPENED: If your pack(s) were not 
  opened on livestream within 7 days of purchase
 
For all exceptions:
Contact us within 48 business hours via surgicaltcg@gmail.com with order number, proof (photos/tracking/stream timestamp), and clear explanation.

4. LIVESTREAM PROCESS
 
4.1 How It Works
 
• Orders are added to the livestream queue in 
  order of receipt
• Your name is called when your pack(s) are up
• All openings are performed live and fully 
  recorded
• You don't need to be live - we open and ship 
  even without your presence
• You can watch via Twitch: @surgicaltcg
 
4.2 Livestream Issues
 
• During technical problems (internet outage, 
  platform issues), the stream resumes as soon 
  as possible
• If your pack was already announced but could 
  not be opened, it will be opened at the start 
  of the next stream
• We are not liable for missed stream moments
• We are not responsible for Twitch platform 
  outages or access issues

5. SHIPPING & STORAGE
 
5.1 Shipping Options
 
SHIPPING COSTS:
• Netherlands: €7.50
• Belgium: €12.00
• Germany: €11.00
• France: €15.00
• Spain: €18.00
• Italy: €20.00
 
EXPECTED DELIVERY TIME:
• Netherlands: 1-2 business days
• Belgium & Germany: 2-3 business days
• France, Spain & Italy: 5-6 business days
 
You have two choices at checkout:
 
• DIRECT SHIPPING: Your cards are shipped within 
  1 day after the livestream in which your pack(s) 
  were opened
 
• STORAGE: We keep your cards until you indicate 
  you want them shipped
  - Free storage for up to 30 days
  - Perfect if you want to combine multiple orders 
    to save on shipping costs
  - Visit the Shipping Information page for shipping
 
5.2 Packaging
 
• All cards are protected in penny sleeves
• Valuable cards receive extra protection in 
  toploaders
• Bubble mailers for extra protection during 
  transport
• Tracking information is automatically provided 
  with shipping
 
5.3 Shipping Responsibility
 
• CHECK YOUR ADDRESS: Ensure your shipping 
  address is correct - we are not responsible 
  for incorrect addresses you provided
• After handover to the carrier (PostNL, DHL, 
  or other shipping partners), we are not 
  liable for delays or loss by the carrier

6. PAYMENT & PAYMENT METHODS
 
6.1 Accepted Payments
 
We accept:
• iDEAL (recommended for Dutch customers - instant 
  payment confirmation)
• Credit/Debit Card (Visa, Mastercard, American 
  Express, Discover)
• PayPal
• Apple Pay & Google Pay
• Shop Pay
• Klarna (Buy Now Pay Later)
 
⚠️ IMPORTANT WHEN USING KLARNA/BUY NOW PAY LATER OR PAYPAL
 
When using Klarna, PayPal, or other "buy now pay later" options, the following applies:
 
• UNJUSTIFIED DISPUTES ARE FRAUD: If you file 
  a dispute/chargeback with Klarna, PayPal, or your 
  credit card provider after receiving your cards 
  because you are "disappointed with the pulls" or 
  "didn't get enough value," this is PAYMENT FRAUD 
  and may result in legal action.
 
• VIDEO EVIDENCE: All openings are recorded live 
  on video and permanently stored. These recordings 
  serve as solid proof that:
  - Your pack(s) were opened fairly
  - All cards were shown
  - The correct cards were shipped
 
• CONSEQUENCES OF UNJUSTIFIED CHARGEBACKS:
  - Permanent ban from our service and Twitch 
    livestreams
  - Billing of all costs: chargeback fees 
    (€25-50) + administrative costs
  - Reporting to other TCG sellers (industry blacklist)
  - Report to local authorities for fraud
  - Possible legal action for recovery + damages
 
• LEGITIMATE PROBLEMS? For real issues 
  (non-received package, damaged cards, missing 
  cards) contact us FIRST via surgicaltcg@gmail.com. 
  We respond within 48 business hours and work to 
  resolve your issue. Only if we don't respond or 
  provide no solution may you open a dispute with 
  Klarna, PayPal, or your payment provider.
 
NOTE: By paying with Klarna, PayPal, or any other payment method, you confirm you understand that disappointment with pack contents is NOT a valid reason for a dispute or chargeback.
 
6.2 Payment Terms
 
• All prices are in euros and include applicable taxes
• Margin scheme (margeregeling) applies - VAT is 
  not shown separately on invoices
• Payment must be completed before your order 
  is added to the livestream queue
• With Klarna or PayPal: you remain responsible 
  for payment, regardless of which cards come from 
  your pack(s)

7. YOUR RIGHTS & RESPONSIBILITIES
 
7.1 You are responsible for:
 
• Understanding that pack openings are completely 
  random
• Researching sets and pull rates before ordering
• Accepting that you may receive cards with lower 
  value than what you paid
• Providing correct address and contact information
• Payment according to your chosen payment method's 
  terms (including Klarna payment deadlines)
• Reporting legitimate problems within 48 business 
  hours after receipt
 
7.2 We are responsible for:
 
• Using 100% authentic, non-tampered booster packs
• Opening your pack(s) fairly and transparently 
  on livestream
• Showing all cards from your pack(s)
• Safely packaging and shipping all cards from 
  your opening
• Providing tracking information with shipping
• Responding to legitimate complaints within 
  48 business hours

8. LIABILITY
 
8.1 Limitation of Liability
 
SurgicalTCG is NOT liable for:
 
• Random contents of booster packs (determined 
  by the manufacturer)
• Low pull rates or "bad luck" with openings
• Market value fluctuations of cards after opening 
  or shipping
• Disappointment with pulls, expectations, or 
  hoped-for cards
• Loss or damage by carrier after handover with 
  tracking
• Temporary technical problems during livestreams 
  (internet, Twitch platform issues)
• Changes in livestream times (with prior notice)
• Card value lower than the pack purchase price
 
8.2 Maximum Liability
 
Our maximum liability is in all cases limited to the amount you paid for the specific order to which the claim relates. We are never liable for indirect damage, consequential damage, or loss of profit.

9. AGE REQUIREMENT & RESPONSIBILITY
 
• You must be at least 18 years old to order 
  via our Rip & Ship service
• We may request ID verification if in doubt 
  about age
• Parents/guardians are fully responsible for 
  orders by minors under their supervision
• Minors ordering without permission: the 
  parent/guardian remains liable for payment

10. PRIVACY POLICY
 
We process your data in accordance with GDPR (EU Regulation 2016/679).
 
Your data is used for:
• Order processing and shipping
• Communication about your order and livestream
• Calling your name during the livestream
• Livestream announcements (only if you give 
  permission)
 
What we DON'T do with your data:
• Your data is NOT shared with third parties, 
  except where necessary for shipping (PostNL/DHL/
  other carriers) and payment processing 
  (Shopify/PayPal/Klarna)
• We don't sell your data
• We don't send spam
 
DATA RETENTION:
• Order data: kept for 7 years (tax requirements)
• Livestream recordings: stored for 90 days 
  (fraud prevention)
• Email communications: kept for 2 years
 
YOUR GDPR RIGHTS:
You have the right to:
• Access your personal data
• Correct inaccurate data
• Request deletion (after retention period)
• Object to processing
• Data portability

LIVESTREAM PRIVACY:
Your name is called during the livestream. If you don't want this, indicate it in the order notes and we'll use an alias or your order number.

11. CHANGES TO TERMS
 
SurgicalTCG reserves the right to change these terms. Changes will be announced at least 14 days in advance via this page (with updated date at the top).
 
By continuing to order after the effective date of changes, you accept the new terms. Orders placed before the change fall under the old terms.

12. APPLICABLE LAW & DISPUTES
 
APPLICABLE LAW:
These terms are governed by Dutch law. For consumers in other EU countries, mandatory consumer protection laws of your country of residence remain applicable where they provide a higher level of protection.
 
COMPETENT COURT:
Any disputes will be submitted to the competent court in the district where SurgicalTCG is located (Arnhem, Netherlands), unless mandatory law dictates otherwise. EU consumers may also bring proceedings in the courts of their country of residence.

13.1 Complaint Procedure
 
STEP 1: Contact us within 48 business hours via surgicaltcg@gmail.com with:
• Your order number
• Clear description of the problem
• Proof (photos, tracking)
 
STEP 2: We respond within 48 business hours with a solution or explanation
 
13.2 What is NOT a valid complaint?
 
• Disappointment with the value of cards from 
  your pack(s)
• "I expected a better pull"
• "Other people pulled better cards"
• "The set has bad pull rates"
• "I would have preferred a different card"
• Market value declining after opening
